Initially analyzing general aspects and ideas that approximate the understanding of the Economic Constitution, freedom of business and the Social Rule of Law, followed by compliance programs in the strict sense and finally its relationship with fundamental rights within the framework of its warranty. The work concludes that the idea of ​​economic utility constitutes a foundation for the violation of fundamental rights, necessitating the inclusion of ethical and moral criteria on business behavior based on constitutional postulates. El presente escrito pretende analizar las implicaciones jurídicas de los programas de cumplimiento o compliance en la garantía de los derechos constitucionales fundamentales en Colombia. Analizando en un primer momento aspectos generales e ideas aproximadoras al entendimiento de la Constitución Económica, la libertad de empresa y el Estado Social de Derecho, seguido de los programas de cumplimiento en sentido estricto y finalmente su relación con los derechos fundamentales en el marco de su garantía. El trabajo concluye que la idea de la utilidad económica constituye un fundamento para la violación de los derechos fundamentales haciendo necesario la inclusión de criterios éticos y morales sobre los comportamientos empresarias con base en postulados constitucionales.
