I26-R133-article-90972020-07-30T16:57:45Z Dialogic public administration: in search of social fundamental rights isonomic concretization Administração Pública dialógica: em busca da concretização isonômica de direitos fundamentais sociais Bourges, Fernanda Schuhli public administration fundamental social rights dialogue social participation development administração pública direitos fundamentais sociais diálogo participação social desenvolvimento This article, from the recognition of the immediate applicability of fundamental social rights and considering that the Republic’s Constitution establishes a Democratic and Social State of Right and, considering the constitutional duty of the Administration to implement those rights, presents the possibility of the adoption of dialogue mechanisms in the administrative action, in order to make the Public Administration compatible with the Constitution, especially so that, based on dialogical social participation, the social fundamental rights may be concretized in advance and isonomically, in their subjective and objective dimensions. The purpose is based on the intensive volume of lawsuits with the aim of fundamental social rights achievement, but those decisions oftenly present non-isonomic effects and with little fundamental social rights realization potential. Thus, from the hypothetical-deductive method, the Dialogical Public Administration is presented with the use of democratic procedures of dialogue with the community, so that the real needs and possible solutions can be harnessed to the anticipated and isonomic accomplishment of the fundamental social rights, especially in its objective dimension. O presente artigo, a partir do reconhecimento da aplicabilidade imediata dos direitos fundamentais sociais e tendo em vista que a Constituição da República estabelece um Estado Democrático e Social de Direito e, considerando-se o dever constitucional da Administração implementar aqueles direitos, apresenta a possibilidade da adoção de mecanismos de diálogo na atuação administrativa, a fim de compatibilizar a Administração Pública com a Constituição, especialmente para que, a partir de participações sociais dialógicas, sejam concretizados os direitos fundamentais sociais antecipadamente e de forma isonômica, nas suas dimensões subjetivas e objetivas. A proposta tem como pressuposto a constatação do volume de demandas judiciais com o fim de concretizar direitos fundamentais sociais, porém, referidas decisões produzem efeitos muitas vezes não isonômicos e com reduzido potencial de concretização de direitos fundamentais sociais. Assim é que, a partir do método hipotético-dedutivo, se apresenta a Administração Pública dialógica com a utilização de procedimentos democráticos de diálogo com a coletividade, para que possam ser colhidas as reais necessidades e eventuais soluções à concretização antecipada e isonômica dos direitos fundamentais sociais, especialmente em sua dimensão objetiva.
