From the concepts of sexual rights and sexual politics, understood here as necessary presuppositions for a more holistic understanding of the social management of the issue in Brazil, the recent clashes around Resolution 01/99 within the scope of the judiciary have been focused, addressing CFP's legitimate normative competence for the edition of the act, as well as its effective material constitutionality, from the perspective of internal constitutional law and also of the Universal and Inter-American Human Rights Protection Systems. It was also addressed the specific issue of egodistonic homosexuality, its removal from the main international classifications of diseases and the prospects of appropriate therapeutic practices. The research was conducted through a literature review oriented on the issue, searching documents and jurisprudence of internal and international bodies. As several attempts to repeal Resolution 01/99 have been taking place in recent decades, either by law or court, the importance of the debate on sexual reorientation therapies for the defense of fundamental rights is evident. A proposta deste trabalho é analisar as controvérsias acerca da Resolução 01/99 do Conselho Federal de Psicologia, ato normativo que proibiu psicólogos de praticarem as chamadas terapias de reorientação sexual, popularizadas como “cura gay”. A partir dos conceitos de direitos sexuais e políticas sexuais, entendidos aqui como pressupostos necessários para uma compreensão mais holística da gestão social da questão no Brasil, tomou-se como foco os recentes embates em torno da Resolução 01/99 no âmbito do poder judiciário, abordando-se a legítima competência normativa do CFP para a edição do ato, assim como sua efetiva constitucionalidade material, sob a ótica do direito constitucional interno e também dos Sistemas Universal e Interamericano de Proteção aos Direitos Humanos. Tratou-se ainda da questão específica da homossexualidade egodistônica, sua retirada das principais classificações internacionais de doenças e as perspectivas de práticas terapêuticas apropriadas. A pesquisa se deu através de revisão bibliográfica orientada acerca da questão, busca em documentos e jurisprudência de órgãos internos e internacionais. Na medida em que diversas tentativas de revogação da Resolução 01/99 vem ocorrendo nas últimas décadas, seja por via legislativa ou judicial, evidencia-se a importância do debate em torno das terapias de reorientação sexual para a defesa de direitos fundamentais.
