Particular emphasis is placed on practices that reveal the juxtaposition between healthcare interventions and custodial interventions. It describes the regulations, policies and current programs that frame the daily dynamics of people in conflict with the criminal law interned in psychiatric institutions. Three types of judicial practices are analyzed: the evaluation of responsibility, the assessment of endangerment, and the evaluation of simulation. It is concluded that the juxtaposition between the penal device and the assistance device, far from constituting a simplistic antagonism, is articulated in such a way that the functions can be inverted between one and other. In addition, the presence of patients in conflict with the criminal law causes modifications in the hospital landscape, which reinforce custodial features and tasks. This indicates that there is currently a process of penitentiarization of psychiatric hospitals. El artículo presenta los avances de una investigación desarrollada en una institución pública de internación psiquiátrica de Santa Fe, que tiene como objetivo general indagar de qué modo se ejerce el gobierno de la locura a través del análisis de las prácticas de atención y políticas vigentes en salud mental en contextos de encierro. Se hace hincapié particularmente en las prácticas que revelan la yuxtaposición entre intervenciones asistenciales del área salud y las custodiales del sistema penitenciario. Se describe la normativa, políticas y programas vigentes que encuadran la dinámica cotidiana de personas en conflicto con la ley penal internadas en instituciones psiquiátricas. Se analizan tres tipos de prácticas judiciales de las que son objeto: la evaluación de responsabilidad, la evaluación de peligrosidad, y la evaluación de simulación. Se concluye que la yuxtaposición entre dispositivo penal y dispositivo asistencial, lejos de constituirse en un antagonismo simple, se articula de modo que las funciones pueden verse invertidas entre uno y otro. Además, la presencia de pacientes en conflicto con la ley penal provoca modificaciones en el paisaje hospitalario, que refuerzan rasgos y tareas custodiales. Ello permite señalar que en la actualidad tiene lugar cierto proceso de penitenciarización de los hospitales psiquiátricos.
