Nevertheless, Apel remains in the Kantian trend, in the sense of the apriorism universalistic. The foundation is done within the frame of a “pragmatic-transcendental reflection” and consists of showing the “discourse principle” or the “basic norm” as condition of possibility to any argumentation. This principle states the exigency that all the conflicts of interests should be solved through “practical discourses” (that is to say, dialogues in which the consensus about a line of action should be chase for all the possible affected). The characteristic -and also the Apel’s original contribution- results to be the recognition of that, a sufficiently based principle, cannot be applicable in certain situations. This determines the need of a “part B” of ethics, in which Apel investigates the conditions of possibility to the application. The present study concludes marking the boundaries of some pendant questions in Apel’s ethics as well as showing that the general balance favors the contributions more than those questions. La “ética del discurso” elaborada por Karl-Otto Apel representa una propuesta de “fundamentación” ética en la que se procura una “transformación” de la ética kantiana mediante dos recursos principales: el pasaje de la perspectiva monológica a la dialógica, y la superación del “rigorismo”. Se mantiene, sin embargo, en la línea kantiana, en el sentido del apriorismo universalista. La fundamentación se hace en el marco de una “reflexión pragmático-trascendental” y consiste en mostrar el “principio del discurso” o la “norma básica” como condición de posibilidad de toda argumentación. Ese principio se expresa como exigencia de que todos los conflictos de intereses sean resueltos por medio de “discursos prácticos” (es decir, diálogos en los que se busque el consenso de todos los posibles afectados acerca de una línea de acción). Lo característico —y, a la vez, el aporte original de Apel— es el reconocimiento de que un principio suficientemente fundamentado puede no ser aplicable en determinadas situaciones. Esto determina la necesidad de una “parte B” de la ética, en la que Apel indaga las condiciones de posibilidad de la aplicación. El presente trabajo concluye con el deslinde de algunas cuestiones que quedan “pendientes” en la ética de Apel, aunque también con la aclaración de que en el balance general pesan más los aportes que los problemas pendientes.
