To sustain the administrative duty to respect their previous decisions in the field of social rights and also the judicial precedents on the subject, the article presents constitutional foundations that underlie the referred duty, the necessary requirements for its configuration and a few concrete examples. Analizando el problema de la satisfacción desigual de los derechos fundamentales sociales por los Poderes Públicos brasileños, el artículo propone, como mecanismo destinado a una tutela igualitaria de dichos derechos por los órganos administrativos, el reconocimiento del carácter vinculante de los precedentes administrativos y judiciales a la Administración Pública. Para sostener el deber administrativo de respetar sus decisiones precedentes en materia de derechos sociales y también los precedentes judiciales sobre el tema, el artículo presenta fundamentos jurídico-constitucionales que basan el referido deber, los requisitos necesarios para su configuración y algunos ejemplos concretos.
