The paper analyzes several existing paradigms in Latin America, and examines the results obtained for each of the communities in which they were applied. All of this in view of the housing problems which affect more than one third of Latin America’s population. According to UN-Habitat, the most pressing difficulty is the lack of serviced land, followed by the danger to which marginal sectors are exposed regarding safe possession. Possession, which we understand, does not necessarily relate with property rights since there are other ways of access, such as rentals under protective legislation. In Argentina, there may be news regarding urban rentals if the Unification Project of the Civil and Commercial Codes, currently under debate by the Senate, is approved. Surely, the pressing and overwhelming situation of the vulnerable sectors cannot be solved by the sole action of the States, so participation of the civil society, whether developers, NGOs, members of academia, and specialized professionals, or others, is essential. Este trabajo trata sobre la significancia que puede tener el derecho al acceso a la vivienda y su relacionamiento con el derecho de propiedad. Analiza diversos paradigmas existentes en América Latina y examina los resultados logrados por cada una de las comunidades en la que estos fueron aplicados. Ello, en miras los problemas de vivienda afectan a más de un tercio de la población en América Latina. La dificultad más acuciante conforme ONU-Hábitat es la carencia de suelo servido, seguidos por el peligro al que se encuentran expuestos los sectores marginales respecto de la tenencia segura. Tenencia, que entendemos, no se relaciona necesariamente con el derecho de propiedad, ya que existen otras formas de acceso, como por ejemplo el alquiler con legislación protectoria. En la Argentina, puede haber novedades en materia de locaciones urbanas, si se aprueba el proyecto de Unificación de los Códigos Civil y Comercial que hoy se encuentra en debate en el Senado. Seguramente, la situación apremiante y desesperante de los sectores vulnerables, no podrá ser solucionada por la actuación solitaria de los Estados, siendo imprescindible la participación de la sociedad civil, se trate de desarrolladores, ONGs, académicos, profesionales especializados, etcétera.
