It is discussed whether these acts should be classified as a continuing crime or whether the rules of the real competition apply. On many occasions, the courts apply the figure of a continuing crime whose criminal scale is lower than that of material competition, without considering the special vulnerability of the minor victims who suffer abuse, who suffer it - most of the time - without the presence of witnesses, with the aggressor being able to reiterate it as many times as possible. The hypothesis that is deduced is that, when there is a plurality of similar harmful acts, carried out against the sexual integrity of the same minor and perpetrated by the same aggressor, the scale corresponding to the actual contest must be applied. To this end, doctrine and jurisprudence of the Superior Court of Justice of the province of Córdoba on the combination of crimes and continued crime and the legal right protected in sexual abuse will be examined. En este trabajo se analiza la jurisprudencia del Tribunal Superior de Justicia de la provincia de Córdoba referente al delito de abuso sexual reiterado en el tiempo cuando la víctima es un niño, niña o adolescente. Se discute si dichos actos deben calificarse bajo la figura de delito continuado o si se aplican las reglas del concurso real. En muchas ocasiones, los tribunales aplican la figura del delito continuado cuya escala penal resulta inferior a la del concurso material, sin considerar la especial vulnerabilidad de las víctimas menores de edad que padecen los abusos, quienes lo sufren -la mayoría de las veces- sin la presencia de testigos, logrando el agresor reiterarlo tantas veces como sea posible. La hipótesis que se deduce es que, cuando exista una pluralidad de actos lesivos similares, efectuados contra la integridad sexual de una misma persona menor de edad y perpetrados por el mismo agresor, se debe aplicar la escala correspondiente al concurso real. Para ello, se examinará doctrina y jurisprudencia del Tribunal Superior de Justicia de la provincia de Córdoba sobre el concurso de delitos y delito continuado y el bien jurídico protegido en el abuso sexual.
