Using a qualitative approach and descriptive design, bibliographic, legal and newspaper sources were reviewed to understand the theoretical and regulatory foundations applicable in both countries. It is concluded that, although the business sector questions such control, it legitimately and proportionally affects the freedom of enterprise, since it is aimed at preserving a competitive order in the market. The State, acting in its regulatory role and under the principle of subsidiarity, exercises preventive vigilance over possible abuses of dominance and concentrates its action on avoiding serious or irreparable economic damage. Both countries apply control systems based on economic thresholds, the Chilean model being flexible and adaptive, while the Peruvian model is characterized by its rigidity. This difference highlights the need for Peru to update its regulations, considering the volatility and constant innovation of the current economic environment. Thus, ex ante control is not only legally justified, but also plays an essential role in the balance between economic freedom and general welfare. El presente estudio analiza si el control preventivo (ex ante) de concentraciones empresariales, destinado a proteger la libre competencia, incide en el derecho a la libertad de empresa según la legislación de Perú y Chile. Mediante un enfoque cualitativo y diseño descriptivo, se revisaron fuentes bibliográficas, legales y hemerográficas para comprender los fundamentos teóricos y normativos aplicables en ambos países. Se concluye que, aunque desde el sector empresarial se cuestiona dicho control, este afecta de forma legítima y proporcional la libertad de empresa, al estar orientado a preservar un orden competitivo en el mercado. El Estado, actuando en su rol regulador y bajo el principio de subsidiariedad, ejerce vigilancia preventiva sobre posibles abusos de posición de dominio y concentra su acción en evitar perjuicios económicos graves o irreparables. Ambos países aplican sistemas de control basados en umbrales económicos, siendo el modelo chileno flexible y adaptativo, mientras que el peruano se caracteriza por su rigidez. Esta diferencia resalta la necesidad de que Perú actualice su normativa, considerando la volatilidad e innovación constante del entorno económico actual. Así, el control ex ante no solo se justifica jurídicamente, sino que cumple un rol esencial en el equilibrio entre libertad económica y bienestar general.
