It analyzes definitions and their legal context, emphasizing the role of the family. The paper examines the relationship between the Civil and Commercial Code's provisions on capacity restriction and the regulation of mental health law, considering concepts of autonomy and family. Additionally, it discusses fundamental issues and the debate surrounding involuntary hospitalization in relation to the family and identifies implications of the concept of "mental health" in family law institutions, including marriage and parental responsibility. El presente trabajo aborda una sistematización acerca de la importancia del concepto de salud mental y su tratamiento en el ordenamiento legal argentino. Se analizan definiciones preliminares y su marco legal, destacando el papel que juega la familia. Se examina la relación entre la normativa del Código Civil y Comercial con la regulación de la restricción de la capacidad de las personas y los derechos de los individuos con padecimientos de salud mental, teniendo en cuenta los conceptos de autonomía y familia. Además, se mencionan las cuestiones esenciales que hacen a la internación involuntaria con respecto al grupo familiar y se identifican implicancias del concepto de “salud mental” en instituciones del Derecho de Familia; en el matrimonio, el parentesco y la responsabilidad parental.
