This article aims to assess how the fight against corruption can affect individual guarantees. The methodology used is the bibliographic survey, which allowed the analysis of different perspectives on the subject. The results show that, in some cases, the fight against corruption can lead to a state of judicial exception, where individual guarantees are violated in the name of the fight against corruption. In addition, in some situations it can be considered lawfare, which is the use of the legal system as a political weapon, also a form of violation of individual guarantees in the context of combating corruption. Thus, the article concludes that it is important that the fight against corruption is carried out in a fair and balanced way, guaranteeing individual freedoms and democracy. Este artigo tem como objetivo avaliar como o combate à corrupção pode afetar as garantias individuais. A metodologia utilizada é o levantamento bibliográfico, o que permitiu a análise de diferentes perspectivas sobre o tema. Os resultados mostram que, em alguns casos, o combate à corrupção pode levar a um estado de exceção judicial, onde as garantias individuais são violadas em nome da luta contra a corrupção. Além disso, em algumas situações pode-se revestir como lawfare, que é a utilização do sistema jurídico como arma política, também uma forma de violação das garantias individuais no contexto do combate à corrupção. Dessa forma, o artigo conclui que é importante que o combate à corrupção seja realizado de forma justa e equilibrada, garantindo as liberdades individuais e a democracia.
