Una lectura moderna y dinámica de la Constitución Nacional abre la puerta al paradigma de los derechos de la naturaleza en Argentina. Podría interpretarse que los mismos encuentran su raíz constitucional en los derechos implícitos, en el deber de preservación de la diversidad biológica, en la re interpretación del término “habitante”, en la cosmovisión de las comunidades indígenas asociada a la defensa de la madre tierra o en el reconocimiento de la naturaleza como derecho autónomo realizado por la Corte Interamericana de Derechos Humanos.
