The problem is whether the possible opening of doors to a new era that brings a symbolic dimension of the judicialization of rights to Nature would not only be of nominal legality. The general objective is to demonstrate the feasibility of recognizing Nature as a subject because it is a manifestation of the Pluricultural State and to emphasize that biocentric conceptions are capable of promoting more effective legal protection of damages caused against Nature, as well as as it takes the form of a step against the coloniality exercised by the countries of the North on the global South. To carry out the research, a critical,methodological line and the methodology of literature review were adopted to present a theoretical observation on the debate on the subject in Latin America with the emergence of the New Latin American Constitutionalism, especially in the 21st century, as a manifestation of biocultural rights. Esta investigación es una reflexión sobre las interfaces de los derechos de la Naturaleza que se han convertido en un nuevo paradigma decolonial frente a la crisis ecológica derivada del actual modelo de explotación de los recursos naturales para la producción y reproducción del capitalismo en el sistema-mundo moderno-colonial. La problemática es si la posible apertura de puertas a una nueva era que traiga una dimensión simbólica de la judicialización de los derechos a la Naturaleza no sería sólo una legalidad nominal. El objetivo general es demostrar la factibilidad de reconocer a la Naturaleza como sujeto de derechos por ser manifestación del Estado Pluricultural y enfatizar que las concepciones biocéntricas son capaces de promover una protección jurídica más efectiva de los daños causados contra la Naturaleza, así como toma la forma de un paso contra la colonialidad ejercida por los países del Norte sobre el Sur global. Para llevar a cabo la investigación se adoptó una línea crítico-metodológica y la metodología de revisión de literatura para presentar una observación teórica sobre el debate del tema en América Latina con el surgimiento del Nuevo Constitucionalismo Latinoamericano, especialmente en el siglo XXI, como manifestación de los derechos bioculturales.
