Within the international scope of government procurement, arbitration has been intensified in line with article 17 of the Political Constitution of the United Mexican States to resolve conflicts involving state entities, including productive enterprises of the state, as well as in the laws in the matter. The objective of this article is to define the coverage and scope of an arbitration agreement, how and when such a clause is agreed and mainly if it is based on a contract, an internal law, or an international treaty. Una cláusula de solución de controversias dentro de un contrato público, otorga certidumbre a las partes y seguridad jurídica para el cumplimiento o ejecución en las condiciones y término, s pactados. Dentro del ámbito internacional de la contratación pública, se ha intensificado el arbitraje en consonancia con el artículo 17 de la Constitución Política de los Estados Unidos Mexicanos para resolver conflictos donde intervengan entidades estatales, incluyendo empresas productivas del estado, así como en las leyes en la materia. El objetivo de este artículo es delimitar la cobertura y alcance de un acuerdo arbitral, cómo y cuando se pacta una cláusula de esta naturaleza y principalmente si se fundamenta en un contrato, en una ley interna o en un tratado internacional.
