Although such a social model became the established procedure by officials and legislators, there is still a lack of knowledge about its meaning and scope. In Río Negro, the Legislature unanimously passed Law D N° 4.532, by which that province adheres to the Convention on the Rights of Persons with Disabilities and its Optional Protocol. Instead of establishing measures to make the convention operational, legislators ignored the fact that the treaty was already in place in their jurisdiction and passed a bill without any legal effect. This highlights the tensions within the federal organization of the Argentinean State, since the adoption mechanisms established by the national Constitution for the coming into force of international treaties were not acknowleged. En la República Argentina se encuentra vigente la Convención sobre los Derechos de las Personas con Discapacidad, la que establece el “modelo social” de la discapacidad, pero las políticas públicas para este colectivo están ancladas en el modelo rehabilitador, reguladas principalmente por las leyes N° 22.431 y 24.901. Si bien tal modelo social se hizo de uso corriente por parte de funcionarias, funcionarios, legisladores y legisladoras, aún existe desconocimiento sobre su significado y alcance. En Río Negro, la Legislatura sancionó por unanimidad la ley D N° 4.532, por la cual esta provincia adhiere a la Convención sobre los Derechos de las Personas con Discapacidad y su Protocolo Facultativo. En vez de establecer medidas para operativizar la convención, las legisladoras y los legisladores ignoraron el hecho de que el tratado ya regía en su jurisdicción y aprobaron una norma sin efecto jurídico alguno. Ello pone de manifiesto las tensiones dentro de la organización federal del Estado argentino, en virtud de que no se dio reconocimiento a los mecanismos de adopción que la Constitución nacional establece para la entrada en vigor de los tratados internacionales.
