description AbstractThis paper presents an analysis of the amparo action, its requirements and its implications when observing it from a jurisprudential sphere that addresses issues related to mental health, the competence of the judiciary and administrative power, and a scenario of urgent needs. The analysis is focused on some aspects of the judicial trajectory and the case “Gutiérrez, Griselda Margarita and another versus Hospital Interzonal Alejandro Korn and another on amparo action” in Argentina. From a critical perspective and with a focus on human rights, the objective of this article is to reflect on the importance of judicial guarantees of fundamental rights, in particular, the access to justice for people with mental/intellectual disabilities. Likewise, the exploration covers how this issue differentially affects women with mental conditions, and the connections to the good practices of the legal actors and public policiesinvolved.
