description This paper aims to discuss the right to education in hospital environments, both in Brazil and Argentina. Through a comparative research between affirmative and regulatory policies, we found out that the main connection between education and health is through the protection of children, youth and adolescents to their development and the cognitive and affective processes of construction of their learning, prescribed in national laws. However, while Brazil enrolls the Hospital Class within the Special Education modality, in Argentina it is recognized as its own modality (Hospital and Home Education), with specific purposes and objectives.
