This paper analyses two judicial files from the early 19th century, corresponding to the archives of the Real Audiencia -specifically those de la Justicia del Crimen de Buenos Airesand its hinterland-, which were under the direct jurisdiction of the Alcalde de la Santa Hermandad. e objective is toanalyse, from the perspective of the social history of justice and the intersectionality of gender, age and social rank - in the context of a society with strong community ties and a supposedly "low-intensity patriarchy" - the episodes of violence and abuseexercised by males over girls' bodies. e extreme vulnerability of the girls led, in the cases studied, their parents, especially their mothers, to denounce and deploy a series of strategiesand actions before judicial officials, seeking moral reparation for the harm caused. A range of issues, which show the details of these judicial practices, the situations of conflict, the registerof emotions of those involved, but also the clear imprint of social and gender inequalities, in a context of political and cultural transition –which is far from being linear and markedlydisruptive– where the discourses of modernity begin to circulatearound the representations of childhood and the configurationof the idea of motherhood. Among the series of questions and indications that these sources generate, a series of questions are raised, such as to what extent was there evidence of specialtreatment of children (particularly girls) and what happened withregard to the behaviour and ties of their parents, mothers and fathers, in this social reality. In short, it is a question of accounting –once again– for the persistent and diverse forms of domination over women in a specific time and space. |

En el presente trabajo se analizan dos expedientes judiciales de los albores del XIX, correspondiente a los Archivosde la Real Audiencia -específicamente los de la Justicia del Crimen de la ciudad de Buenos Aires y su hinterland-, que estaban bajola competencia directa de los Alcaldes de la Santa Hermandad. El objetivo que se persigue es el de analizar, desde la perspectiva de la historia social de la justicia y la interseccionalidad de género, edad y rango social –en el marco de una sociedad con fuertes lazos comunitarios y de un supuesto “patriarcado de baja intensidad”– los episodios de violencias y abusos ejercidos por los varones sobre el cuerpo de las niñas. La extrema vulnerabilidad de las niñas llevó a que, en los casos estudiados, sus progenitores, especialmente, sus madres, denunciaran y desplegaran una serie de estrategias y acciones ante los funcionarios judiciales, buscando la reparación moral ante el daño ocasionado. Un abanico decuestiones, que muestran los pormenores de estas prácticasjudiciales, las situaciones de conflicto, el registro de emociones dequienes quedan involucrados, pero también la clara impronta delas desigualdades sociales y de género, en un contexto de transiciónpolítica y cultural –que lejos está de ser lineal y marcadamente disruptiva- donde comienzan a circular los discursos de la modernidad en torno a la representaciones de la niñez y laconfiguración de la idea de la maternidad. Entre la serie deinterrogantes e indicios que estas fuentes generan, se planteanuna grilla de cuestiones como, hasta qué punto se evidencióun tratamiento especial de la niñez (de modo particular de lasniñas) y qué aconteció respecto al proceder y los vínculos de susprogenitores, madres y padres, en esa realidad social. Se trata, en definitiva, de dar cuenta –una vez más– de las formas persistentes y diversas de dominación sobre las mujeres en un tiempo y espacio concreto.
