The aim of this article is to analyze two key moments during the democratic transition in Argentina in which the supremacy of the Constitution was threatened: the military uprising in the Easter of 1987 and December 1990. I will approach this from a political and constitutional perspective, considering the notion of defense of the Constitution in a context of exception in which the political and legal order itself is in danger. La cuestión de la defensa de la Constitución es uno de los debates más importantes y arduos de la teoría constitucional y política. El objetivo de este artículo es analizar dos momentos fundamentales de la transición democrática en la Argentina donde se puso en juego con particular énfasis la vigencia de la Constitución: los levantamientos militares de la Pascua de 1987 y de diciembre de 1990. Lo hago desde una perspectiva de teoría política y constitucional a partir de una noción de defensa de la Constitución adecuada para contextos de excepción en el que el propio orden está en peligro. A questão da defesa da Constituição é um dos debates mais importantes e difíceis da teoria constitucional e política. O objetivo deste artigo é analisar dois momentos fundamentais da transição democrática na Argentina em que a validade da Constituição foi colocada em jogo com ênfase especial: os levantes militares da Páscoa de 1987 e de dezembro de 1990. Faço isso a partir de uma perspectiva da teoria política e constitucional baseada em uma noção de defesa da Constituição que é apropriada para contextos de exceção nos quais a própria ordem está em perigo.
