Through the use of court records and legal works, this research reconstructs the practices and strategies undertaken by workers, employers and administrative officials, showing the ways in which judges, through their rulings, paved the way for the enactment of the law. Este artículo explora una serie de conflictos en torno a la naturaleza de los contratos colectivos que se dirimieron en los estrados del fuero laboral en los años inmediatamente anteriores a la sanción la ley de convenciones colectivas de trabajo de 1953. Mediante la utilización de expedientes judiciales y obras jurídicas, esta investigación reconstruye las prácticas y estrategias emprendidas por trabajadores, patrones y funcionarios administrativos, dando cuenta de las formas en que los jueces, a través de sus sentencias, allanaron el camino a la sanción de la norma. Este artigo explora uma série de conflitos relativos à natureza dos contratos coletivos que foram resolvidos na justiça do trabalho nos anos imediatamente anteriores à promulgação da Lei dos Acordos Coletivos de Trabalho de 1953. Através do uso de arquivos judiciais e obras jurídicas, esta pesquisa reconstrói as práticas e estratégias empreendidas por trabalhadores, empregadores e funcionários administrativos, dando conta das formas como os juízes, através das suas sentenças, abriram caminho para a sanção da norma.
