| Sumario: | Based on a historical analysis of the evolution of fire risk in Chilean territory, and its management by the Chilean authorities, this article aims to explain the reasons that led the members of the Codifying Commission responsible for drafting the Chilean Penal Code of 1874 to sanction Article 483, which presumed the guilt of the merchant if his establishment or house was destroyed by fire.
