This provision had no precedent either in the previous compiled legislation. A partir de un análisis histórico del evolución del riesgo de incendio en territorio chileno, y su gestión por parte de las autoridades chilenas, el presente artículo quiere explicar las razones que llevaron a los miembros de la Comisión Codificadora encargada de redactar el Código Penal chileno de 1874 a sancionar con el artículo 483 la presunción de culpabilidad del comerciante en el caso que su establecimiento o casa resultase destruido por un incendio: una disposición que no tenía ningún precedente ni en la antigua legislación recopilada, ni en los demás códigos decimonónicos. A partir de uma análise histórica da evolução do risco de incêndio em território chileno, e de sua gestão pelas autoridades chilenas, este artigo visa explicar os motivos que levaram os membros da Comissão Codificadora encarregada de redigir o Código Penal Chileno de 1874 a sancionar com o artigo 483.º a presunção de culpa do comerciante no caso de o seu estabelecimento ou casa ser destruído por um incêndio: disposição que não tinha precedentes nem na antiga legislação compilada nem nos demais códigos do século XIX.
