From an iushistoriographical perspective, we will examine the norms and parliamentary and doctrinal debates that generated the legal reserve established by article 67, paragraph 11 of the National Constitution. Finally, it will examine how the Supreme Court of Justice of the Nation understood this article and the ways it implemented to overcome it. El presente trabajo discute que, en el proceso de construcción del estado nacional, la forma como el régimen federal, consagrado en la Constitución Nacional, entendió la relación entre jurisdicción y territorio se proyectó en las normas constitucionales referidas a la sanción de los códigos y su aplicación. A partir de una perspectiva iushistoriográfica se examinará las normas y debates parlamentarios y doctrinarios que generó la reserva establecida por el artículo 67, inciso 11 de la Constitución Nacional. Finalmente, se indagará cómo la Corte Suprema de Justicia de la Nación comprendió dicha reserva y las vías que instrumentó para superarla. O presente trabalho discute que, no processo de construção do Estado nacional, a forma como o regime federal, consagrado na Constituição Nacional, entendia a relação entre jurisdição e território foi projetada nas normas constitucionais referentes à sanção dos códigos e sua aplicação. Numa perspectiva iushistoriográfica, serão examinadas as normas e debates parlamentares e doutrinários que geraram a reserva estabelecida pelo artigo 67, parágrafo 11 da Constituição Nacional. Por fim, será investigado como o Supremo Tribunal de Justiça da Nação entendeu esta reserva e as formas que implementou para superá-la.
