Both, used by small and medium farmers to maintain or improve land rights in a Chilean agricultural setting during the first half of the 19th century. It investigates the crisis of pacts for the sharing possession, pressured by the advance of institutions and interests linked to the paradigm of full domain. The review of lawsuits and sales contracts confirmed that the appeal to both figures was intended, on the one hand, to keep the old possessory agreements and, on the other, to concentrate domain rights. El artículo analiza el uso judicial de dos derechos preferenciales de compra: tanto y retracto. Ambos, utilizados por pequeños y medianos agricultores para mantener o mejorar derechos a la tierra en un escenario agrícola chileno durante la primera mitad del siglo XIX. Se indaga la crisis de pactos por la compartición de la posesión, presionados por el avance de instituciones e intereses ligados al paradigma del dominio pleno. La revisión de pleitos y contratos de compraventa corroboró que la apelación a ambas figuras pretendía, por un lado, mantener los antiguos acuerdos posesorios y, por otro, concentrar los derechos de dominio. O artigo analisa a utilização judicial de dois direitos preferenciais de compra: ambos e de retirada. Ambos, utilizados por pequenos e médios agricultores para manter ou melhorar os direitos à terra no cenário agrícola chileno durante a primeira metade do século XIX. Investiga-se a crise dos pactos de partilha de posse, pressionados pelo avanço de instituições e interesses ligados ao paradigma da propriedade plena. A análise das ações judiciais e dos contratos de venda confirmou que o recurso a ambas as figuras visava, por um lado, manter os antigos contratos de posse e, por outro, concentrar os direitos de propriedade.
