However, despite its depth, there are gaps with respect to the conservation and protection of the oceans beyond the areas under national jurisdiction. The purpose of this paper is to reflect on the protection of marine biodiversity in these areas within the framework of the regime born with the UNCLOS and its implementation agreements, considering the current negotiation process of a new binding legal instrument for this purpose. Focusing this paper on fishing and protection of species from the 201st mile, and on legal nature of genetic resources, we haveresorted to the analysis of legal instruments that are part of this regime, as well as to the writings of specialized researchers in the areas involved in order to provide a conceptual framework for this article. La Convención de Naciones Unidas sobre el Derecho del Mar de 1982 (CONVEMAR) estableció un nuevo régimen internacional para los océanos determinando derechos y obligaciones de los Estados en las diversas zonas, la naturaleza jurídica y límites de dichos espacios, así como las reglas aplicables a la navegación, la exploración y explotación de los recursos naturales, las instalaciones, la preservación del medio marino, la investigación científica y la transferencia de tecnología. Sin embargo, y pese a su profundidad, presenta lagunas respecto a la conservación y protección de los océanos más allá de las zonas bajo jurisdicción nacional. El presente trabajo tiene como objetivo reflexionar en torno a la protección de la biodiversidad marina endichas áreas en el marco del régimen nacido con la CONVEMAR y sus acuerdos de implementación, considerando el proceso de negociación actual de un nuevo instrumento jurídico vinculante a tal fin.
