In Argentina, it crystallizes in the law 10.903 of patronage of minors (1919) andformally governed until the enactment of a new regulatory framework that conceives children as subjects ofLaw –Convention on the rights of the child (1989), national Act No. 26.061 (2005) and Bill Provincial 12.967 (2009). This paradigm shift occurs at the same time clinching the neo-liberal model, which involved for the Argentine social structure deep transformations, accompanied by processes of naturalization of inequality, the criminalization of poverty as a central element of these processes. Reinforce the ideas of social dangerousness, constructing a stigma that enables cutting repressive interventions on neighborhoods and youth. Social policies are insufficient to transform the conditions of violation of the rights of the child and juvenile population, so it is imperative to prioritize public policies to the girls, boys and adolescents. From the Assembly for the rights of children and youth, we promote the Declaration of public emergency in the field of childhood and youth in Rosario. La representación de la infancia comienza en la modernidad, con la construcción del Paradigma Tutelar o de Situación Irregular. En Argentina, se cristaliza en la Ley 10.903 de Patronato de Menores (1919) y rige formalmente hasta la sanción de un nuevo marco normativo que concibe a los niños como Sujetos de Derecho –Convención sobre los Derechos del Niño (1989), Ley Nacional Nº 26.061 (2005) y Ley Provincial 12.967 (2009). Este cambio de paradigma se produce al mismo tiempo que se afianza el modelo neoliberal, que implicó para la estructura social argentina profundas transformaciones, acompañadas por procesos de naturalización de la desigualdad, siendo la criminalización de la pobreza un elemento central de esos procesos. Se refuerzan sobre los barrios populares y los jóvenes las ideas de peligrosidad social, construyendo una estigmatización que habilita intervenciones de corte represivo. Las políticas sociales resultan insuficientes para transformar las condiciones de vulneración de derechos de la población infanto- juvenil, por lo que se hace imperioso priorizar dentro de las políticas públicas a las niñas, niños y adolescentes. Desde la Asamblea por los Derechos de la Niñez y la Juventud, impulsamos la declaración de Emergencia Pública en Materia de Niñez y Juventud en Rosario.   Universidad Nacional de Rosario.
