Firstly, we begin by regarding the formative character in every law, as long as language consisting of ‘the real’ when naming it, so as to then analyze in particular some aspects of each of the three selected laws, two of them corresponding to provincial laws (San Juan province, Law N° 10772) and the National Mental Health and Addiction Law N° 26657. Thirdly, a brief overview is presented that allows us to call into question what is considered ‘madness’ as a natural object to be understood as a category which is built by discourses that have been traversed by history and culture. El presente trabajo se propone indagar los modos en que distintas leyes de salud mental constituyen el campo al que hacen referencia. Partimos de suponer el carácter performativo de toda ley, en tanto el lenguaje constituye “lo real” al nombrarlo, para luego analizar en particular algunos aspectos de cada una de las tres leyes seleccionadas, dos de carácter provincial (provincia de San Juan, ley Nº 6976 y provincia de Santa Fe, ley N° 10772) y la ley Nacional de Salud Mental y Adicciones N° 26657. En un tercer momento se presenta un breve recorrido que nos permite poner en cuestión a “la locura” como objeto natural para abordarla, en cambio, como una categoría construida por discursos atravesados por la historia y la cultura.
