To that end, it examines the case brought by South Africa before the International Court of Justice (ICJ) and the preliminary ruling issued by the Court in January 2024, which acknowledged the plausibility of the accusation. Employing a qualitative approach, the study is based on documentary analysis, including the parties' submissions to the ICJ, international resolutions, reports by human rights organizations, and statements from state actors. The theoretical framework draws on the traditions of realism and constructivism, allowing for an analysis of both Israel’s strategic and security interests and the symbolic and normative disputes underlying South Africa’s actions and the international community’s responses. Within this context, the article reflects on the role of international law as a mechanism for regulating armed conflicts, as well as on the legitimacy —or contestation— of specific state practices from the perspective of shared international responsibility in the face of mass atrocities. El presente artículo analiza la actual ofensiva militar del Estado de Israel sobre la Franja de Gaza a la luz del derecho internacional, considerando la posibilidad de que dicha acción constituya un acto de genocidio. Para ello, se examina el caso impulsado por Sudáfrica ante la Corte Internacional de Justicia (CIJ) y el fallo preliminar emitido por este tribunal en enero de 2024, que reconoció la plausibilidad de la acusación. A partir de un enfoque cualitativo, se recurre a un análisis documental que abarca las presentaciones de las partes ante la CIJ, resoluciones internacionales, informes de organismos de derechos humanos y declaraciones de actores estatales. El marco teórico se inscribe en las tradiciones del realismo y el constructivismo, permitiendo abordar tanto los intereses estratégicos y de seguridad del Estado de Israel como las disputas simbólicas y normativas que subyacen al accionar sudafricano y a las reacciones de la comunidad internacional. En este contexto, se reflexiona sobre el rol del derecho internacional como herramienta de regulación de los conflictos armados, así como sobre la legitimación —o cuestionamiento— de determinadas prácticas estatales desde una perspectiva de responsabilidad internacional compartida.
