Within this framework, we seek to contribute to the debate around the possibilities, potentialities and/or limitations of this “indigenous participation” in a context of underfunding and regressive social policies which effectively restricts the very possibility of participation. For that purpose, we first take a brief historical overview to show how Law 26160 was drafted and passed. Then, we review the concept of “participation” within the framework of indigenous policies, paying attention to how this participation took shape(s) in the design, implementation and evaluation of the survey. Finally we analyse the decree that repeals the Law, to close the writing by reflecting on the challenges involved in thinking about indigenous participation, interculturality and plurinationality amid the context of anarchocapitalism and the rise of new right-wing movements.

Partiendo de investigaciones previas, en el presente artículo abordamos la idea-práctica de participación indígena en el marco de la Ley de Emergencia Territorial 26160, sancionada en 2006 y recientemente derogada por decreto presidencial, focalizando en la implementación del relevamiento territorial. En este marco, buscamos aportar al debate en torno a las posibilidades, potencialidades y/o limitaciones de esta “participación indígena” en un contexto de desfinanciamiento y retrotraimiento de políticas sociales que clausuran la posibilidad misma de participar. Para ello, realizamos primero un breve recorrido histórico para mostrar cómo se llega a la formulación y sanción de la Ley 26160. Luego, revisamos el concepto de “participación” en el marco de las políticas indigenistas, atendiendo a cómo esta participación tomó forma(s) en el diseño, implementación y evaluación del relevamiento. Posteriormente, analizamos el decreto que deroga la Ley, para cerrar el escrito reflexionando sobre los desafíos que conlleva pensar la participación indígena, la interculturalidad y la plurinacionalidad en el marco del anarcocapitalismo y el avance de las nuevas derechas. Com base em pesquisas anteriores, neste artigo abordamos a ideia-prática da participação indígena no marco da Lei de Emergência Territorial 26160, aprovada em 2006 e recentemente revogada por decreto presidencial, com foco na implementação do levantamento territorial. Neste contexto, procuramos contribuir para o debate em torno das possibilidades, potencialidades e limitações desta “participação indígena” num contexto de desfinanciamento e reversão de políticas sociais que fecham a própria possibilidade de participação. Com este propósito, em primeiro lugar faremos uma breve revisão histórica para mostrar o modo em que a Lei 26160 foi formulada e aprovada. Seguidamente, revisaremos o conceito de “participação” dentro do marco das políticas indígenas, considerando como essa participação tomou diferentes modalidades no desenho, implementação e avaliação da pesquisa. Logo analisamos o decreto que revoga a Lei, para finalizar a redação refletindo sobre os desafios que envolve pensar a participação indígena, a interculturalidade e a plurinacionalidade no marco do anarcocapitalismo e o avanço da nova direita.
