The European Union’s response was unprecedented, having resorted, for the first time in history, to a European instrument that had been adopted more than twenty years ago: the Temporary Protection Directive. With the activation of this mechanism by the Council of the European Union, priority was given to a quick and urgent solution, intended for all Member States to protect those affected by the war. However, it is important to critically analyse this solution, and question why it was not adopted in previous cases of massive influx of people to the European Union. Neste artigo vamos refletir sobre as soluções encontradas pela União Europeia para responder a uma “crise de refugiados sem precedentes”: a do recente movimento em massa de deslocados da Ucrânia, após a invasão russa de fevereiro de 2022. A resposta da União Europeia foi inédita e, pela primeira vez na história, utilizou um instrumento europeu que tinha sido adotado há mais de vinte anos: a Diretiva relativa à proteção temporária. Com a ativação deste mecanismo pelo Conselho da União Europeia, foi favorecida uma solução rápida e urgente, de modo que todos os Estados-Membros protegessem as pessoas afetadas pela guerra da mesma forma. No entanto, é importante examinar criticamente a solução assim encontrada e questionar em particular por que razão não foi ela adotada em casos anteriores de afluxo maciço de pessoas para a União Europeia.
