Special consideration will be given to the systematic and structural conditions of discrimination and violence that transvestite and trans women experience as a consequence of prejudices and stereotypes that respond to a cisbinary conception of society and that constitute obstacles to equal access to rights, derived the lack of implementation of public policies and concrete barriers to access to justice. Rethinking the categories from which institutional violence is analyzed constitutes a strategy capable of moving towards the inclusion in dignity and rights of the collective of trans women, understanding that it is not enough to respect differences, but that it is necessary to move towards a plural democracy , diverse and inclusive that recognizes and guarantees citizenship in terms of equality and non-discrimination to all people. El artículo busca avanzar en la producción de conocimiento sobre las violencias estatales, profundizando y complejizando el análisis de la violencia institucional desde un enfoque de género, diversidad y derechos humanos, a partir del estudio de un caso de violencia policial producido en contra de una joven trans durante el ASPO en la provincia de Jujuy. Se considerarán especialmente las condiciones sistemáticas y estructurales de discriminación y violencia que atraviesan el colectivo de mujeres travestis, transexuales y transgénero, como consecuencia de prejuicios y estereotipos que responden a una concepción cisbinaria de la sociedad y que constituyen obstáculos para el acceso igualitario a los derechos, derivados de la falta de implementación de políticas públicas y de barreras concretas en el acceso a la justicia. En este sentido, repensar las categorías desde las que se analiza la violencia institucional constituye una estrategia capaz de avanzar hacia la inclusión en dignidad y derechos del colectivo de mujeres trans, entendiendo que no basta con respetar las diferencias, sino que es necesario avanzar hacia una democracia plural, diversa e inclusiva que reconozca y garantice ciudadanía en términos de igualdad y no discriminación a todas las personas.
