Conceptualizing the genocide occurred in the period of 1974-1983 as the founding element of a new national culture in sociological and institutional terms, we describe the implications that such speeches cause in contemporary life under the paradigm of rule of law. Next, we reflect upon the penalization of denialist speech in the light of the current proposals of criminal proscription of it. To that end, we make a comparative study of the criminal law experiences developed by different countries. Subsequently, we weigh the tensions between freedom of speech, protection of historical Memory and penalization of denialism through the constitutional and conventional standards of Human Rights which structure the post-dictarioral Argentinian State. Finally, we value the criminalization of denialism as a necessary public policy in order to consolidate historical Memory and to continue the struggle for Memory, Truth and Justice. El artículo analiza el fenómeno del negacionismo y las formas que asumen dichas prácticas en el caso argentino. Conceptualizando al genocidio ocurrido en el período 1974-1983 como el elemento fundante de una nueva normatividad nacional en términos sociológicos e institucionales, se describen las implicancias que dichos discursos traen aparejado a la vida contemporánea bajo el paradigma del Estado de Derecho. Seguidamente, se reflexiona acerca de la punibilidad del discurso negacionista a raíz de las actuales propuestas legislativas de proscripción penal del mismo. Para ello, se realiza un estudio comparado de las experiencias jurídicas en materia penal elaboradas por distintos Estados frente a la problemática tratada. Posteriormente, sopesamos las tensiones existentes entre libertad de expresión, tutela de la Memoria histórica y punibilidad del negacionismo a la luz de los estándares constitucionales y convencionales en materia de Derechos Humanos que estructuran el Estado postdictatorial argentino. Por último, valoramos la sanción penal del negacionismo como una política pública necesaria para el afianzamiento de la Memoria histórica y la continuidad de la lucha por Memoria, Verdad y Justicia.
