Sumario:Argentinian Patentability guidelines for pharmaceutical products show examiners how to apply patentability requirements to particular circumstances and are a useful tool to avoid evergreening. In order to check the scope of these guidelines, a content analysis of antiretroviral oppositions was carried out, characterizing the arguments used and correlating the relevant categories appearing in the Guidelines and contained in the opposition arguments. The argumentative categories mostly used are: lack of novelty and inventive step, non compliance with enhancement and descriptive insufficiency. In correlation with the Guidelines it is observed that: formulations and compositions, polymorphs and salts and esters are the most litigated categories. The content of the Guidelines as nonpatentable material corresponds with the arguments used in the oppositions, backing up their application and the possibility to reduce the need to use the opposition mechanism, avoiding evergreening for irrelevant incremental innovations.
