description Argentinian Patentability guidelines for pharmaceutical products show examiners how to apply patentability requirements to particular circumstances and are a useful tool to avoid evergreening. In order to check the scope of these guidelines, a content analysis of antiretroviral oppositions was carried out, characterizing the arguments used and correlating the relevant categories appearing in the Guidelines and contained in the opposition arguments. The argumentative categories mostly used are: lack of novelty and inventive step, non compliance with enhancement and descriptive insufficiency. In correlation with the Guidelines it is observed that: formulations and compositions, polymorphs and salts and esters are the most litigated categories. The content of the Guidelines as nonpatentable material corresponds with the arguments used in the oppositions, backing up their application and the possibility to reduce the need to use the opposition mechanism, avoiding evergreening for irrelevant incremental innovations.

Las Pautas de Patentabilidad para productos farmacéuticos de Argentina instruyen a los examinadores sobre cómo aplicar los requisitos de patentabilidad a circunstancias particulares y son una herramienta útil para evitar el evergreening.Para corroborar el alcance de dichas Pautas se realizó un análisis de contenido de oposiciones a antirretrovirales, caracterizando las argumentaciones utilizadas y correlacionando categorías relevantes presentes en las Pautas y contenidas en las argumentaciones de oposiciones.Las categorías argumentativas mayormente utilizadas son: falta de novedad y altura inventiva, no cumplimiento de mejora en la eficacia e insuficiencia descriptiva. En correlación con las Pautas se observa a las categorías: formulaciones y composiciones, polimorfos, sales y ésteres como las mayormente litigadas.El contenido de las Pautas para materia no patentable coincide con los argumentos utilizados en las oposiciones, apoyando su aplicación y afirmando que reducirían la necesidad de utilización del mecanismo de oposición, evitando la perpetuación de patentes para innovaciones incrementales irrelevantes. As Diretrizes de Patenteabilidade para Produtos Farmacêuticos na Argentina instruem os avaliadores sobre como aplicar os requisitos de patenteabilidade a determinadas circunstâncias e são uma ferramenta útil para evitar o evergreening. Para conferir a abrangência destas Diretrizes, efetivou-se uma análise do conteúdo das oposições aos antirretrovirais, caracterizando os argumentos utilizados e correlacionando as categorias relevantes presentes nas Diretrizes e contidas nos argumentos das oposições. As categorias argumentativas mais utilizadas são: falta de novidade e inventividade, descumprimento de melhoria de eficiência e insuficiência descritiva. Em correlação com as Diretrizes, as categorias observadas são: formulações e composições, polimorfos, sais e ésteres, como os mais litigados. O conteúdo das Diretrizes para matérias não patenteáveis coincide com os argumentos usados na oposição, apoiando a sua implementação e afirmando que reduziriam a necessidade de usar o mecanismo de oposição, evitando a perpetuação de patentes irrelevantes para a inovação incremental.
