In August 2010, the Legislature of Córdoba sanctions law 9814, a regulation whose aim is to protect the provincial native forests through a territorial planning, based on a set of criteria and categories that define different conservation areas. The legislative discursive field that results in this regulation is highly controversial, according to the provincial political scenario that configures it and the treatment given to the law in the Legislature of Córdoba. In the parliamentary process that takes place between 2008 and 2010, at least two proposals coexist and a fairly long work is carried out in commissions. Once the time has come for treatment on the legislative chamber, discussions between competing alternatives are certainly controversial and the resolution of the conflict is given by the interposition, at the last moment, of an official project (Unión por Córdoba). The level of controversy that characterizes this legislation case is privileged ground to analyze the discursive tactics and strategies in conflict, and in this article we concentrate on those that refer to one of the controversial dimensions of the debate: the discursive confrontation around the notions of consensus, legitimacy and legality of the approved text. By means of a discourse analysis of the stenographic version of the session in which this law is voted, we offer a characterization of the parliamentary process and the problematic nodes, to reflect on whether or not we are actually facing a political deliberation and what defines it precisely. If we consider that law 9814 awaits an update with real challenges for the Cordoba Parliament, this article may offer valuable insights for the next stages in environmental protection of the native forests of Córdoba. |

En agosto de 2010 la Legislatura de Córdoba sanciona la ley 9814, una normativa cuyo objetivo es proteger a los bosques nativos provinciales por medio de un ordenamiento territorial, basado en un conjunto de criterios y categorías que definen diversas zonas de conservación. El campo discursivo legislativo que tiene por efecto el contenido de esta normativa es altamente controvertido, de acuerdo con el escenario político provincial que lo configura y el tratamiento que se le da al proyecto de ley en la Legislatura de Córdoba. En el proceso parlamentario que transcurre entre 2008 y 2010 coexisten al menos dos propuestas y se desarrolla un trabajo en comisiones bastante prolongado. Una vez llegado el momento de tratamiento en el recinto, las discusiones entre las alternativas en pugna son ciertamente polémicas y la resolución del conflicto se da por la interposición a último momento de un proyecto oficialista (Unión por Córdoba). El nivel de controversia que caracteriza a este caso de legislación es un terreno privilegiado para analizar las tácticas y estrategias discursivas en conflicto, y en este artículo nos concentramos en aquellas que refieren a una de las dimensiones polémicas del debate: el enfrentamiento discursivo por las nociones de consenso, legitimidad y legalidad del texto sancionado. A partir de un análisis de discurso de la versión taquigráfica de la sesión en la que se vota esta ley, ofrecemos una caracterización del proceso parlamentario y de los nodos problemáticos, para reflexionar si en efecto estamos o no frente a una deliberación política, y qué la define precisamente. Si consideramos que se trata de una ley tan vigente como controvertida, que aguarda una actualización con verdaderos desafíos para el parlamento cordobés, este artículo puede ofrecer reflexiones valiosas para los próximos avances en materia de protección ambiental de los bosques nativos de Córdoba.
