The acceleration of capitalist transnationalization in recent decades has been supported by the diffusion and application of a neoliberal-based development model, as well as adjustments in the field of law as a way to ensure the accumulation of capital and the impunity of corporations in human rights violations, including environmental ones.The article relies on bbliographic research and field research with interviews and discusses concepts such as discipliny neoliberalism, supremacy, lex mercatoria and new constitutionalism. Based on the Chevron case in Ecuador, the article aims to analyze how corporate transnationalization, human rights violations and impunity are established. It thus notes the contradictions and tensions in Ecuador since the 1990s regarding Chevron's actions in the country and highlights the role of governments, social movements and organizations as they attempt to address the legal limitations for Chevron's effective condemnation. The article presents, therefore, the political and economic context that allowed Chevron's action in the country and the advances and setbacks in the fight for justice inside and outside Ecuador. |

La aceleración de la transnacionalización del capital en las últimas décadas fue sostenida por la difusión y aplicación de un modelo de desarrollo de base neoliberal, además de ajustes en el campo del derecho, como forma que garantizar la acumulación del capital y la impunidad de las empresas en las violaciones de derechos humanos, incluidos los ambientales. El artículo se apoya en investigación bibliográfica y de campo con entrevistas, discutiendo cómo los conceptos de neoliberalismo, disciplinamiento neoliberal, supremacía, lex mercatoria y nuevo constitucionalismo contribuyen para caracterizar el modo en que el capital transnacional se establece en las últimas décadas. El caso Chevron en Ecuador es expuesto, aunque brevemente, indicando cómo se constituyen concretamente los mecanismos que garantizan la reproducción del capital, con énfasis en el papel esencial del derecho para garantizar la globalización neoliberal. El artículo discute, así, los contextos políticos y económicos que permitieron históricamente la acción de Chevron en el país y los avances y retrocesos de la lucha por justicia de los afectados en diferentes jurisdicciones. El caso Chevron es simbólico porque consigue evidenciar la asociación entre transnacionalización del capital, neoliberalismo y derecho orientado al mercado. A aceleração da transnacionalização do capital nas últimas décadas foi sustentada pela difusão e aplicação de um modelo de desenvolvimento de base neoliberal, além de ajustes no campo do direito como forma de garantir a acumulação de capital e a impunidade de empresas em violações de direitos humanos, incluídos os ambientais. O artigo se apoia em pesquisa bbliográfica e pesquisa de campo com entrevistas e discute conceitos como neoliberalismo, disciplinamento neoliberal, supremacia, lex mercatoria e novo constitucionalismo. Com base no caso Chevron no Equador, o artigo objetiva analisar como se estabelecem a transnacionalização de empresas, as violações de direitos humanos e a impunidade. Observa, assim, as contradições e tensões no Equador desde a década de 1990 referente às ações da Chevron no país, com destaque para o papel dos governos no Equador, de movimentos e organizações sociais.na tentativa de enfrentar as limitações jurídicas para a efetiva condenação da Chevron.
