We investigate the antidemocratic constitutional adoption of key corporate principles of the new global lex mercatoria, as well as its regulatory and practical impact on the violation of human rights. Finally, based on the notions of corporate power and human rigthsbased approach, we identified the subordination of various rights to mining business interests, in two specific conflicts related to the Conga and Las Bambas megaprojects. In this way, we intend to contribute to reflect on the primacy of human rights, particularly those associated with struggles for environmental justice and the defense of indigenous territories, against corporate power. Este artículo aborda el problema de la asimetría existente entre las garantías jurídicas de los intereses de las empresas transnacionales y grupos de poder económico, y la protección de los derechos humanos de las personas, comunidades y pueblos afectados por la expansión de megaproyectos extractivos en Perú. Indagamos la adopción constitucional antidemocrática de principios corporativos claves de la nueva lex mercatoria global, así como su impacto regulatorio y práctico en la vulneración de derechos humanos. Finalmente, partiendo de las nociones de poder corporativo y enfoque de derechos, identificamos la subordinación de diversos derechos a los intereses empresariales mineros, en dos conflictos concretos relacionados a los megaproyectos Conga y Las Bambas. De este modo, pretendemos contribuir a la reflexión sobre la primacía de los derechos humanos, en particular los asociados a las luchas por la justicia ambiental y la defensa de territorios indígenas, frente al poder corporativo.
