Incidencia en la normativa electoral de la República Argentina Becerra Córdoba, Gerardo Andrés supranormatividad transnormatividad estado democracia derecho parlamento supranormativity transnormativity state democracy law parliament On December 29, 2014, the Argentine Congress enacted Law No. 27.120 regarding the election of Parliamentarians of Mercosur, in compliance with the provisions of the regional body in the Protocol Establishing the Mercosur Parliament, making important changes to specific electoral norms of our country such as the National Electoral Code, the Political Parties Financing Law, and the Primary Elections Act (PASO), in order to adapt the electoral processes already in effect to these new elective offices of supranational importance. In the present work, we will address the most important aspects of these modifications, the nature of these new elective offices and the community legislative body that they make up, their history, current integration, the normative value of their provisions, and the system of election of parliamentarians in Argentina. We will deal specifically with the aforementioned modifications to the local electoral legislation regarding the candidates for parliamentarians, their election, the interrelation of the electoral campaigns, other charges at stake in the same election, and finally the special legal status and the judicial control of these new ones transnational elective positions, always taking into account that the electoral law is not reduced to the scope of the rules, but covers many more aspects of the political life of a country, a region and the world. Con fecha 29 de diciembre de 2014, el Congreso Argentino sanciónó la Ley N° 27.120 referida a la elección de Parlamentarios del Mercosur, dando cumplimiento a lo dispuesto por el organismo regional en el Protocolo Constitutivo del Parlamento del Mercosur, realizando importantes modificaciones a normas electorales específicas de nuestro país tales como el Código Electoral Nacional, la Ley de Financiamiento de los Partidos Políticos, y la Ley de Elecciones Primarias (PASO), a los fines de adecuar los procesos electorales ya vigentes a éstos nuevos cargos electivos de trascendencia supranacional. En el presente trabajo, abordaremos los aspectos más importantes de estas modificaciones, la naturaleza de estos nuevos cargos electivos y del cuerpo legislativo comunitario que conforman, su historia, integración actual, el valor normativo de sus disposiciones, y el sistema de elección de parlamentarios en Argentina. Trataremos en forma específica las modificaciones ya mencionadas a la legislación electoral local respecto a los candidatos a parlamentarios, su elección, la interrelación de las campañas electorales existiendo otros cargos en juego en una misma elección, y finalmente los fueros y el control judicial de estos nuevos cargos electivos transnacionales, teniendo en cuenta siempre que el derecho electoral no se reduce al ámbito de las normas, sino que abarca muchos más aspectos de la vida política de un país, de una región y del mundo.
