Thereafter, new authorities of the recently nationalized company aimed to replace increasing energy imports, derived from oil and gas domestic extraction decline. Maturity of traditional over-exploited wells, directed expectations to Vaca Muerta, an oil and gas shale play located in the Neuquén Basin. In 2013, presidential Decrees 927 and 929 introduced incentives to attract investments and satisfy concessionaires’ demands, in particular those related with exports and overseas profit conveyance. In October 2014, Law N° 27.007 was sanctioned which modified Law N° 17.319. The latter is in force since 1967 and is considered the hydrocarbon industry’s "Mother Law". The new legislation incorporates advantages set out by the previously implemented decrees, favoring operators’ benefit maximization. Current National Government´s guidelines deepen this approach. The purpose of this work is to analyze policies driven to promote hydrocarbon exploitation in Argentina, as well as its territorial incidence, focusing on the experience of Vaca Muerta. Based on previous own research, the methodology includes regulations’ reviewing, indicators’ analysis and site observation, among other techniques. The concept of governance will be examined as the neo-liberal rationality feature, considering that it helps to reflect on the current State’s role.

La Ley 26.741/12 determinó la recuperación del control estatal de Yacimientos Petrolíferos Fiscales (YPF), declaró la búsqueda del autoabastecimiento energético y expresó la reafirmación de la soberanía hidrocarburífera. El objetivo planteado por la conducción de la empresa de bandera a partir de entonces fue sustituir las crecientes importaciones de energía, correlato directo de la declinación de la extracción interna de petróleo y gas. Ante la madurez de los sobre-explotados yacimientos tradicionales, las expectativas se centraron en los hidrocarburos contenidos en el interior de la formación geológica Vaca Muerta, localizada en la Cuenca Neuquina. En el año 2013 se emitieron los decretos presidenciales 927 y 929, que contemplan una serie de estímulos tendientes a atraer inversiones y a satisfacer reclamos que venían solicitando las concesionarias. En particular, aquellos referidos a la posibilidad de exportar y de remitir utilidades a las casas matrices. En octubre de 2014 fue sancionada la Ley 27.007, que reformula la Ley 17.319, vigente desde 1967 y considerada la “Ley Madre” de la actividad. La nueva legislación incorpora las ventajas establecidas en los decretos instrumentados previamente, favoreciendo la maximización de beneficios de las operadoras. Los lineamientos del gobierno nacional asumido en 2015 profundizan este rumbo. El propósito del trabajo es analizar las políticas impulsadas para promover la explotación de hidrocarburos en Argentina, así como su incidencia en el territorio, haciendo foco en la experiencia de Vaca Muerta. Partiendo de investigaciones propias, la metodología incluye la revisión en profundidad de la normativa, el análisis de indicadores y la observación en terreno, entre otras técnicas. Se recurre al concepto de governance como rasgo propio de la racionalidad neoliberal, en tanto contribuye a reflexionar sobre el rol del Estado en el período actual.
