In Brazil and other Latin American countries, for economic reasons, due to a plethora of legal demands and due to the intend of national governments and market players to establish a new way of dealing with conflict, we highlight the process by which we are witnessing, in the public and private domain of such countries, the use of extrajudicial methods and instruments in different spheres of action and debate than in the context of traditional public arenas. Through conducting a conflict resolution field genealogy, as well as by historicizing the creation and amending of legal and institutional base of these countries and by the identification of social management strategies developed by market players, we try to demonstrate that the mentioned field is the result of changes occurred in the capitalist system, notably in its recent neoliberal form. This indicates the need for deeper analysis of the decision-making process in the extrajudicial sphere over the possible "solutions" to the problems and conflicts in society. En el presente artículo se buscó evidenciar que la “resolución negociada” del conflicto y sus discursos y prácticas fueron, desde los períodos de guerra hacia el final del siglo XIX e inicio del siglo XX hasta la actualidad, aplicadas en las dinámicas conflictivas de diferentes áreas. En Brasil y en otros países de América Latina, por cuestiones económicas, por una serie de factores vinculados al aumento de demandas judiciales y por la intensión de gobiernos nacionales y de los agentes de mercado se estableció una nueva forma de tratamiento de conflictos. Debemos destacar el proceso del cual estamos siendo testigos, en el dominio público y privado de estos países, el uso de métodos e instrumentos extrajudiciales en ámbitos de actuación y debate diferentes al contexto de los espacios públicos tradicionales. Mediante la realización de una genealogía del campo de la resolución negociada del conflicto, historizando la creación y modificación de la base legal-institucional de los referidos países y a través de la identificación de estrategias de gestión social desarrolladas por agentes de mercado, buscamos demostrar que el citado campo es fruto de transformaciones ocurridas en el sistema capitalista, especialmente en sus recientes contornos neoliberales. Esta realidad indica la necesidad imperiosa de un examen de todo el proceso de toma de decisión en la esfera extrajudicial sobre las posibles soluciones para los problemas y conflictos en la sociedad.
