Do also we question about the legislative reception of the method in our country in particular to family disputes and if possible from the legal rules to impose a qualitative change in the interpersonal relationships of the family system? We start from understanding family, the protagonist and target both the conflict and the impact; the crisis is opportunity of change and transformation, and resolution which is circumstantially capable of producing, design will determine the quality of the course of the system. Nos preguntamos sobre la eficacia de la mediación como respuesta a los conflictos familiares, en términos de diseño y de solución del conflicto planteado: en lo privado -para los conflictuantes en crisis- en lo público -para el sistema jurídico argentino de regulación de las relaciones familiares y de la familia en crisis en general-. También sobre la recepción legislativa del método en nuestro país en particular para los conflictos familiares y si es posible desde las normas jurídicas imponer un cambio cualitativo en las relaciones interpersonales del sistema familiar. Partimos del entendimiento que es la familia la protagonista y destinataria tanto del conflicto como del impacto; que la crisis es oportunidad de cambio y transformación y que el diseño de resolución que circunstancialmente sea capaz de producir, determinará la calidad del derrotero del sistema. Entendemos que la mediación está sustentada en la autonomía de la voluntad de los disputantes que se reapropian del conflicto y de la forma de resolverlo. ¿Significará esto, legitimar un desentendimiento del Estado en la regulación de las relaciones familiares y en el control ante los incumplimientos?
