Italia, Grecia interviniente) Salas, Graciel R. judgment jurisdiction of states Second World War sentencia fallo jurisdicción de los estados segunda guerra mundial This recent judgment of the International Court of Justice (February 3, 2012) brings to reflection different legal questions related to events that occurred during the Second World War, which are still producing effects today.Beyond the legal content that we will comment on below, it is important to highlight the growing relationship between International Law and Domestic Law, as evidenced in the ruling we are commenting on.Germany introduced the instance for violations of international legal obligations that Italy would have committed not respecting in its judicial practice the immunity from jurisdiction recognized to Germany by International Law, invoking the European Convention for the Peaceful Settlement of Disputes of April 29, 1957. Italy attempted a counterclaim which was rejected by the Court.Greece requested intervention in the case as an interested third party and in relation to the Greek decisions declared enforceable in Italy which will be discussed below. Este reciente fallo de la Corte Internacional de Justicia (3 de febrero de 2012) trae a la reflexión diferentes cuestiones jurídicas vinculadas con hechos acaecidos durante el desarrollo de la Segunda Guerra Mundial, que aún hoy continúan produciendo efectos.Más allá del contenido jurídico que comentaremos a continuación es de resaltar la creciente relación entre el Derecho Internacional y el Derecho Interno, puesta de manifiesto en el fallo que comentamos.Alemania introdujo la instancia por violaciones a obligaciones jurídicas internacionales que habría cometido Italia no respetando en su práctica judicial la inmunidad de jurisdicción reconocida a Alemania por el Derecho Internacional, invocando la Convención Europea para la Solución Pacífica de Controversias del 29 de abril de 1957. Italia intentó una reconvención que fue rechazada por la Corte.Grecia solicitó la intervención en el caso como tercero interesado y en relación a las decisiones griegas declaradas ejecutorias en Italia que analizaremos más adelante.
