In the injury to the rights of personality over the Internet there are several rights at issue, some of lesser rank, such as freedom of expression, protection of privacy and access to information. Clearly, the debate is much more complex when occurs the geographical dissociation of the elements of the illegal act and attempting to apply territorial norms to the global reality that posed the Web. The challenge is to solve two key issues: first, which jurisdiction is competent to decide the case; the other, which law is applicable. But the answer to these questions is not always easy. The difficulty of locating a specific unlawful act in the virtual world means that, in the field of extra-contractual obligations, the expectations of the participants are directed to several orders, which determines the classical or traditional approach of loci delicti commissi, it of difficult application. The study begins with an analysis of the legal provisions of international conventions agreed at regional level, examining the Treaties of International Civil Law of Montevideo 1889 and 1940, as well as the Bustamante Code of 1928. This leads us to affirm that the solutions adopted in past centuries can not resolve cases related with Internet- that are valid in the XXI Century. This refers to the European experience in the pursuit of find appropriate points of connection to provide legal security, predictability and confidence to those operating in the system. Finally, it emphasizes the need for an inter-American instrument to regulate extra-contractual obligations, without simultaneously knowing the complexity involved in coding task; it must find common solutions to the systems legal of common law and civil law. |

En la lesión de los derechos de la personalidad a través de Internet, aparecen varios derechos en discusión, algunos de jerarquía mayor, como la libertad de expresión, el resguardo de la intimidad y el acceso a la información. Claramente, el debate es mucho más complejo cuando sobreviene la disociación geográfica de los elementos del acto ilícito y se intenta aplicar normas territoriales a la realidad global que plantea la Web. Se abre entonces, el desafío de resolver dos cuestiones esenciales: por una parte, qué jurisdicción es la competente para conocer del caso; por otra, qué legislación es de aplicación. No obstante la respuesta a estos interrogantes no siempre es fácil. La dificultad de localizar un concreto acto ilícito en el mundo virtual propicia que, en el ámbito de las obligaciones extracontractuales, las expectativas de los partícipes se orienten hacia varios ordenamientos, lo que determina que el criterio clásico o tradicional del loci delicti commissi, resulte de difícil aplicación. El estudio se inicia con el análisis del régimen legal previsto en los convenios internacionales acordados a nivel regional, deteniéndonos en el examen de los Tratados de Derecho Civil Internacional de Montevideo de 1889 y de 1940, así como del Código Bustamante de 1928. Ello nos lleva a afirmar que, las soluciones adoptadas en siglos pasados no han sido pensadas y, que por ende, no pueden resolver satisfactoriamente casos relacionados con Internet que se proyectan en el siglo XXI. En este punto, haremos referencia a la experiencia europea en la búsqueda de factores de conexión más apropiados para brindar seguridad jurídica, previsibilidad y confianza, a quienes operen en el sistema. Al finalizar, se destaca la necesidad de elaborar un instrumento interamericano que regule las obligaciones extracontractuales, sin que ello implique desconocer la complejidad que conlleva la tarea codificadora, pues debe encontrar soluciones comunes a los sistemas jurídicos del common law y del civil law.
