CÓMO DEBE APLICARSE EL DERECHO ELEGIDO POR LAS PARTES Quaranta Costerg, Juan Pablo Appeal for annulment Arbitration Departure from the agreed right Recurso de nulidad Arbitraje Apartamiento del derecho pactado This note refers to an appeal for annulment of an arbitration award, in which, according to the plaintiff, the intervening arbitrator departed in his decision from the law agreed upon by the parties. Chamber D of the National Court of Commercial Appeals of the Federal Capital ruled, in a divided ruling, that the arbitrator had not deviated from the applicable law agreed upon by the parties. In the agreement, the parties had agreed to apply Argentine law, meaning the Civil Code of Vélez Sarsfield and not the Civil and Commercial Code. In its decision, the majority held that the institution of the pactum de non petendo had been applied by doctrine and jurisprudence, thus finding reception in Argentine law. Likewise, the reference to the Civil and Commercial Code made by the arbitrators did not imply a departure from the selected applicable law, taking into account that said regulatory body regulates the law applicable to the case in a similar way to the derogated Civil Code. La presente nota a fallo se refiere a un recurso de nulidad contra laudo arbitral, en el cual, según la parte actora, el árbitro interviniente se apartó en su decisión del derecho pactado por las partes mediante autonomía conflictual. La Sala D de la Cámara Nacional de Apelaciones en lo Comercial de la Capital Federal resolvió, en un fallo dividido, que el árbitro no se había apartado del derecho aplicable pactado por las partes. En el pacto, las partes habían acordado aplicar el derecho argentino, entendiendo por tal al Código Civil de Vélez Sarsfield y no al Código Civil y Comercial. En su decisión la mayoría sostuvo que la institución del pactum de non petendo había sido aplicada por la doctrina y la jurisprudencia, encontrando de ese modo recepción en el derecho argentino. Asimismo, la referencia al Código Civil y Comercial efectuada por el árbitro no implicó un apartamiento del derecho aplicable seleccionado, atento que dicho cuerpo normativo regula el derecho aplicable al caso de modo similar al Código Civil derogado.
