This immunity regime does not have legal regulatory support and violates constitutional principles such as those of equality before thelaw and full reparation and that is why a new interpretation of these parameters or jurisprudential requirements is justified so that they adjust to the regime regulations contemplated by the Civil and Commercial Code for all public agents in art. 1766, within which the personnel of the Judicial Branch must be included and also the current reality where primacy is given to the right to reparation. La responsabilidad de los funcionarios judiciales ha sido, por medio de criterios jurisprudenciales y doctrinarios, objeto de una regulación que en los hechos genera un sistema de inmunidad relativa respecto a los daños que aquellos agentes causan con motivo de sus funciones. Ese régimen de inmunidad no tiene respaldo normativo legal y atenta contra principios de índole constitucional como son los de igualdad ante la ley y de reparación plena y es por ello que se justifica una nueva interpretación de esos parámetros o requisitos jurisprudenciales para que se ajusten al régimen normativo que contempla el Código Civil y Comercial para todos los agentes públicos en el art. 1766, dentro de los cuales debe incluirse al personal del Poder Judicial y también a la realidad actual donde se da primacía al derecho a la reparación.
