This is so, product of a legal tradition that essentially remains, despite the changes in the last two centuries. The privileged heir system is a way of continuing undivided rural exploitation, encouraging the family to avoid decapitalization and uprooting. El heredero privilegiado del sistema sucesorio especial agrario europeo tiene su antecedente en el sistema de heredero único, típico de la familia troncal, vigente durante siglos en Europa, y que pervive hoy bajo su actual figura, con la adaptación a las nuevas realidades socio-económicas y jurídico-políticas. Ello es así, producto de una tradición jurídica que en lo sustancial permanece, apesar de los cambios operados en los dos últimos siglos. El sistema de heredero privilegiado es un modo de continuar la explotación rural indivisa, propiciando que la familia evite su descapitalización y desarraigo.
