To this end, the new legal framework is examined, based on the process of Constitutionalization of Private Law that causes a paradigm shift in the field of Human Rights. Indeed, as a result of the Inter-American Convention for the Elimination of All Forms of Discrimination against Persons with Disabilities and the Convention on the Rights of Persons with Disabilities and its optional protocol, a new scenario is being built for the recognition and exercise of rights of the human person. Adopting the reasonable adjustments that allow to safeguard their autonomy for the exercise of their subjective rights in general, and, in particular, those related to their parental responsibility. El presente trabajo tiene como objetivo examinar el régimen jurídico vigente en materia de restricción a la capacidad de ejercicio de las personas humanas en base a la resolución dictada por el Juzgado de Primera Instancia en lo Civil y Comercial de Octava Nominación de la ciudad de Córdoba en los autos caratulados: “O.R., N.S.-Demanda de Limitación a la Capacidad”- (Auto Número 122 de fecha 26/04/2022). Motivó el presente, el siguiente interrogante: ¿Resulta posible la conservación de la responsabilidad parental ante una limitación a la capacidad de ejercicio? A tal fin, se examina el nuevo marco legal, en función del proceso de constitucionalización del Derecho Privado que provoca un cambio de paradigma en materia de Derechos humanos. En efecto, a raízde la Convención Interamericana para la Eliminación de Todas las Formas de Discriminación contra las Personas con Discapacidad y la Convención sobre los Derechos de las Personas con Discapacidad y su protocolo facultativo se construye un nuevo escenario para el reconocimiento y ejercicio de los derechos de la persona humana. Adoptando los ajustes razonables que permitan resguardarsu autonomía para el ejercicio de los derechos subjetivos en general, y, en particular, los relativos a la responsabilidad parental.
