Along with the task of defining the origin of punitive damages, there is the task of establishing reasonable criteria that allow justifying their quantification. Saidcriteria have been expanded in the Draft Consumer Defense Law (art. 118) with respect to the statements in the current regime (art. 52 bis Consumer Defense Law) which is highly positive to serve as guidelines for a better justification of the amount that is judicially ordered to pay as a dissuasive punitive fee. Los daños punitivos tienen esencialmente una finalidad punitiva o sancionatoria, y a partir de entender esa función principal deben precisarse los requisitos necesarios que justifican su imposición a los casos de daños a los consumidores. Junto a la tarea de definir la procedencia de los daños punitivos, se encuentra la de establecer criterios razonables que permitan justificar su cuantificación. Dichos criterios han sido ampliados en el Anteproyecto de Ley de Defensa de Consumidor (art. 118) respecto a los enunciados en el régimen actualmente vigente (art. 52 bis Ley de Defensa de Consumidor) lo que es altamente positivo para servir cómo pautar para una mejor justificación de la cuantía que judicialmente se ordena pagar en concepto de multa punitiva disuasoria.
