In this article I explore a justification of the right to inherit by the descendants of the deceased. This inheritance right is founded on what I call the extension argument. This argument states that the right of children to receive property by inheritance is the extension of certain rights they have with respect to their parents while the latter were alive. In particular, I analyze the possibility of founding an inheritance right on the basis of the children’s need to receive love from their parents and address some objections about central aspects of the thesis presented. As a conclusion, I establish that the objections pointed out impede the justification of the right to inherit as an act of parental love. ¿Qué justifica el derecho de los hijos de heredar bienes de sus padres? En este artículo exploro una posible justificación del derecho a heredar por parte de los descendientes del fallecido. Este derecho hereditario se funda a partir de lo que denomino el argumento de la extensión. Este argumento establece que el derecho de los hijos a recibir bienes por herencia es la extensión de ciertosderechos que tienen con respecto a sus padres mientras estos últimos estaban vivos. En particular, analizo la posibilidad de fundar un derecho hereditario a partir de la necesidad de los hijos de recibir amor de sus padres y abordo algunas objeciones sobre aspectos centrales de la tesis presentada. Como conclusión, establezco que las objeciones señaladas impiden la justificación del derecho a heredar como acto de amor parental.
