Simulation. Fraud. Nullity”- (Sent. No. 65 dated 06/29/2021). The work was motivated in the following question: To what extent can I avoid the autonomy of the will made explicit by the contracting parties in the contract / legal act?To this end, we will examine whether “in truth we are faced with a situation of economic, psychological or psychological inferiority of one of the parties (weak party), compared to another (party in a state of superiority) that exploiting that need or taking advantage of their situation of superiority, the superior party obtained innocuous advantages in the contract whose nullity was sought; or ifit was simply a voluntary, lawful act, performed in good faith by both parties. The injury is an exception to the rule, which should not be used to evade the obligation to fulfill the contract. For this reason, it is considered to be of a restrictive interpretation, having to opt, in case of doubt, for compliance, so as not to dismiss the principle of security in legal acts. El presente trabajo tiene como objetivo examinar los elementos esenciales para la procedencia del vicio de lesión en base a la resolución dictada por la Excelentísima Cámara 1° en lo Civil y Comercial de la ciudad de Córdoba en los autos caratulados: “Cheble, Abdón Antonio c/ Raisz, Alberto José - Ordinario. Simulación. Fraude. Nulidad”- (Sent. Nro. 65 de fecha 29/06/2021). Motivó elpresente, el siguiente interrogante: ¿Hasta qué punto se puede soslayar la autonomía de la voluntad explicitada por las partes contratantes en el contrato/acto jurídico? A tal fin, examinaremos si nos encontramos ante una situación de inferioridad económica, psíquica o psicológica de una de las partes (parte débil), frente a otra (parte en estado de superioridad) que explotando esa necesidad o aprovechamiento de su situación de superioridad, consiguió ventajas inicuas en el contrato cuya nulidad se pretendió; o si simplemente se trató de un acto voluntario, lícito, celebrado de buena fe por ambas partes. La lesión es una excepción a la regla que no debe ser utilizada para eludir la obligación de cumplir con el contrato. Por este motivo, se la considera que es de  interpretación restrictiva, debiendo optarse, en caso de duda, por el cumplimiento para no destituir el principio de seguridad en los actos jurídicos.
